DSS Agents Sue SERAP for N5 Billion Over Defamation Claims

Two operatives from Nigeria's Department of State Service (DSS), Sarah John and Gabriel Ogunleye, have filed a defamation lawsuit against the Socio-Economic Rights and Accountability Project (SERAP).


The suit, lodged in the High Court of the Federal Capital Territory, seeks N5 billion in damages, alleging that SERAP made false accusations against them.


The controversy began when SERAP posted on its X (formerly Twitter) handle, claiming that "officers from Nigeria’s DSS are presently unlawfully occupying SERAP’s office in Abuja, asking to see our directors."


This statement, according to the operatives, was misleading and defamatory. They assert that their visit to SERAP's office on September 9, was merely to invite the organization's new leadership for a familiarization meeting, as directed by the DSS, and not an unlawful invasion.


The operatives argue that the viral nature of SERAP's post led to widespread public condemnation, including remarks from prominent figures like senior lawyer Femi Falana.


This backlash has reportedly caused significant reputational damage to both the operatives and the DSS, leading to an internal investigation and suspension of the claimants.


"The defendants’ statements caused harm to the claimants’ reputation because staff of the DSS have formed the opinion that the ridicule and criticisms received by the DSS are a result of the claimant’s actions," the operatives stated in their legal filing.


They further contend that the situation has taken a severe emotional and psychological toll on them.


In addition to seeking financial compensation, the DSS operatives are demanding a public apology from SERAP. They request that this apology be published on SERAP’s website, X handle, and in two national newspapers and television stations.
